It's becoming crystal clear that Lindsay Lohan and her expert lawyer Mark Heller will NOT be able to charm their way out of rehab, or even JAIL!

Despite making their best efforts to CONVINCE the judge/prosecution that Lindsay is totes fine, does not require rehabilitation, and definitely doesn't deserve JAIL TIME…

It seems her opponents are playing major hard ballz, as they are apparently demanding that any plea deal made inclue one or BOTH of aforementioned outcomes.

One alleged insider reveals:

"The Los Angeles City Attorney is requiring either jail time or rehab for Lindsay as part of any plea deal in her lying to cops case. She would have to go to rehab for at least 60 days, and the jail time would be at least 45 days.

Lindsay refuses to accept ANY deal that has any type of confinement as part of the deal. Someone with her criminal history is lucky to be offered such a great deal, but she just doesn’t seem to understand that. Barring any last shred of common sense on Lindsay’s part, this case is going to trial."

Does Linz honestly think she will have an easier time convincing a jury of her peers that she's innocent and has exceptional mental health??

Is that why Lilo and Mark are fighting these pretty SWEET plea bargains (sweet, considering her past crimes!)?

"Lindsay is ready to go to trial. She has always wanted to face a jury of her peers, and feels confident she will be acquitted. Lindsay has nothing to hide."

SIIGHHH. We are just not seeing the logic behind this confidence! But hey, if she's willing to battle it out, who is anyone to stop her. She may surprise us all…

But to us this seems like yet another questionable, eyebrow-raising move by Mz. Lindsay Lohan in this chess game we call life.
